Terms of Service

1. The Service

BidCraft analyzes freelance job postings you provide, scores them against your own settings, generates proposal hooks from your portfolio and past wins, and tracks your application outcomes. BidCraft is an independent product. It is not affiliated with, endorsed by, or sponsored by Upwork Global Inc. "Upwork" is a trademark of its respective owner and is used only to describe compatibility.

2. Eligibility and accounts

• You must be at least 16 years old and able to form a binding contract to use the Service.
• You must register with a valid email address that you control. Accounts registered with disposable or temporary email addresses may be blocked or removed.
• You are limited to one free account per person. Creating or operating multiple accounts to evade free-plan limits, trials, or any other restriction is prohibited and may result in suspension or termination of all related accounts without notice.
• You are responsible for all activity on your account and for keeping your sign-in email and extension API token secure.

3. Acceptable use

You agree not to:

• Submit content you have no right to use. You may only submit job postings that are visible to you and material that you own, such as your own profile, portfolio, and proposals.
• Circumvent, or attempt to circumvent, rate limits, plan restrictions, or anti-abuse controls, including by using multiple accounts, shared accounts, automation, or IP rotation.
• Probe, scan, or test the Service for vulnerabilities, or access data belonging to other users.
• Use the Service to send spam or to violate Upwork's terms of service or any applicable law.
• Resell, sublicense, or redistribute the Service or its output as a competing product without our written permission.
• Reverse engineer the Service except where such a restriction is prohibited by law.

We monitor aggregate usage signals such as request rates, IP addresses, and email domains to detect abuse. We may throttle, suspend, or terminate accounts that violate this section.

4. Plans, billing, and trials

• The Free plan includes 5 analyses per day and a 30-day rolling job history, at no cost, subject to fair use.
• Pro ($5 per month) and Pro Plus ($10 per month) are billed monthly in advance through Stripe. Prices exclude any applicable taxes, which are added at checkout where required.
• Paid plans include a 7-day free trial for first-time subscribers. One trial per person; trial abuse through multiple accounts is a violation of section 2.
• Subscriptions renew automatically each month until canceled. You can cancel at any time from the billing page; access to paid features continues until the end of the period already paid for.
• If a renewal payment fails, we retry per Stripe's schedule and notify you; if payment is not completed, your account reverts to the Free plan.
• Fees already paid are non-refundable except where required by law or where we terminate your account without cause. We may change prices with at least 14 days notice; changes apply from your next billing cycle.

5. Your content and our license

You retain all ownership of the content you submit: job text, settings, portfolio items, proposals, and logged outcomes ("User Content"). You grant FlowTasks a limited, non-exclusive license to host and process User Content solely to operate and improve the Service for you. This license ends when the content is deleted. We do not use User Content to train machine-learning models and we do not share it with other users.

6. Our intellectual property

The Service, including its software, design, scoring methodology, and branding, is owned by FlowTasks and protected by intellectual property law. These Terms grant you a personal, non-transferable, revocable right to use the Service; they transfer no ownership. Scores, verdicts, and generated hooks produced from your own content are yours to use in your proposals.

7. Results are not guarantees

Scores, verdicts, and generated text are suggestions computed from the information you provide. They are not professional advice and are not guarantees of winning work or earning revenue. You are solely responsible for the proposals you send, the contracts you enter, and your compliance with the terms of any marketplace you use.

8. Termination

• You may stop using the Service at any time and may delete your account from Settings, which permanently deletes your data within 7 days.
• We may suspend or terminate your account for breach of these Terms, for abuse of the Service, for non-payment, or where required by law. Where practical, we will warn you first.
• We may discontinue the Service or any feature with at least 30 days notice for paid functionality; in that case we refund the unused portion of prepaid fees.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that parsing and scoring will be accurate for every job posting.

10. Limitation of liability

To the maximum extent permitted by law, FlowTasks is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or lost data. Our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 3 months before the claim arose or 50 US dollars. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Indemnification

You will indemnify and hold FlowTasks harmless from claims, damages, and reasonable legal fees arising from your User Content, your use of the Service in violation of these Terms, or your violation of any third-party right or applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which FlowTasks is established, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at support@flowtasks.io and attempt to resolve the dispute informally for 30 days. Any claim must be brought within one year of the event giving rise to it, where permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. If you continue using the Service after that date, the updated Terms apply. If you do not agree, stop using the Service and delete your account before the effective date.
